PAYMENT

Please be aware that once you have submitted your initial payment you are agreeing to uphold the design terms below in their entirety.

The method of payment accepted by Foundation Studio is Paypal.
All balances will be due upon acceptance of the completed design project and must be paid in full before it is released to the client or published to the internet. All payments are non-refundable upon receipt. There are no exceptions.

PROJECT DELAY

If circumstances change, and you need to put your project on hold, Foundation Studio will honor your quoted price for a period of 30 days. After 30 days, your project will need to be reassessed at current rates. If you decide not to proceed, all deposits shall be forfeited and any graphics, layouts or mock-ups will remain the property of Foundation Studio.

MOCKUPS, CONCEPTS AND REVISIONS

Foundation Studio will present one design mockup for client to review, based on information received in the order form. If we have totally missed the mark with your design, we will be happy to provide one additional mockup, with the understanding that any further revisions will be billed our hourly rate of $45.

AUTHORIZATION

As the client, you authorize Foundation Studio to install any scripts, software or programs relevant to the web design project and to access your website account through your hosting service control panel (C-Panel) and FTP. You will provide Foundation Studio with the login information and passwords necessary to access your website and server.

COPYRIGHT

The intellectual property and copyrights of your blog design are retained by Foundation Studio, and all pieces of the blog’s design must remain intact. At anytime if you choose to replace elements of the design please be aware that these terms require that you completely remove the Foundation Studio template and choose a brand new template.

Your blog design is published as the creative work of Foundation Studio. It is a reflection of our design style and abilities. If the design is altered in anyway, it is no longer an accurate representation of our work. Should you wish to do a redesign or update please email us to discuss the options.

The graphics and all content of a Foundation Studio project is protected by Copyright. No template, header, background, design, or graphic is to be altered, changed or resold for any purpose. When you purchase a blog/website design it entitles you to use that design on ONE specified URL. You MAY NOT add the design code or graphics to any additional blogs URLs, online forms, or printed projects. You may also NOT copy, slice or cut the design graphics for use on another website, blog, or graphic for any reason without permission from Foundation Studio. If you would like to do so, please contact us as there is a fee to do so.

Hiring another designer to create a “coordinating” graphic for a blog design or graphic from Foundation Studio is in violation of these terms. ALL RIGHTS to the designs produced here are Foundation Studio’s intellectual property and are not to be copied, altered or used in any way other than specified before installation or delivery of the item purchased. Ownership of final artwork designed by Foundation Studio on behalf of the client will be retained by Foundation Studio. This includes include code or software. Copyright on all software and code remains the property of Foundation Studio or its otherwise respective owner. If you wish to purchase high-resolution digital files of your graphics, you may do so for $150.

COMMUNICATION

Once payment has been received and the design of your website has commenced, you must be available via e-mail, able to answer all questions and complete tasks throughout the design process. 99% of all communication is via e-mail and not by phone, fax, postal mail or in person. Keep in mind that I may be sending you frequent emails to gather information, and to have you approve each step of the design process.
You will receive e-mail support for 30 days after your site has been turned over to you. You are encouraged to use this time to load your products and process several test entries to become familiar with the functionality of your site. After 30 days, there may be a charge for hourly support depending on the frequency and complexity of your questions.  Our hourly rate is $45.

PHOTOGRAPHY & OUTSIDE GRAPHICS

When providing artwork, graphics, or photos for use on your site, we require that you have license to use it. This means that it must be a royalty-free stock image or custom designed artwork where the original illustrator, photographer or artist has given you permission to use their work on your site. This will apply to artwork we choose for you as well. Should your design require the purchase of a royalty-free image, we will notify you in advance in order to discuss options and extra payment (if necessary).

COMPATIBILITY

There are many different browsers out there and each has several versions as well. Foundation Studio suggests that you update your browser to the most current version offered. Foundation Studio designs to meet the standards that comply with the latest browser versions and is not responsible for inconsistencies that may appear when older browser versions are used.

DESIGN CREDITS

All graphics, illustrations, and layouts are intended to be kept whole as given to you.  All work done by Foundation Studio may not be used by anyone else but the specified client on the domain for which it was originally designed. All preliminary mockups to include graphics, layouts, etc., which are not selected by the client remain the full property of Foundation Studio and may be used in future projects for other clients.
Foundation Studio retains all rights to display artwork in portfolios and advertising materials. E-mail testimonials from clients may be posted on our Testimonials Page.
All website designs by Foundation Studio require a image link footer back to Foundation Studio unless other arrangements have been made. The client guarantees that links back to Foundation Studio will remain in place until such time as that website design is no longer published on the Internet. Removal of this link is in violation of this agreement and subject to breach of contract.

LIABILITY

Any service purchased from Foundation Studio is provided ‘as is’ without warranty of any kind that the web design project will be uninterrupted or error-free. In no event will Foundation Studio be liable to you or any third party, on any legal theory for any direct, indirect, special, incidental, punitive, exemplary or consequential damages arising out of the use of any Foundation Studio service, graphic or code, or the use of any hosting service, service provider, telecommunications carrier, internet servers, third party e-commerce programs, or your site visitor’s computer or internet software, including, without limitation, service interruptions caused by Acts of God and/or Nature, or any other circumstances beyond our reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.
Foundation Studio will make no warranty to cover AOL, text-based or old browsers or requested special effects that have been advised against.

ADDITIONAL INFO

• Foundation Studio reserves the right not to participate in the designing of a blog that is deemed to be vulgar, profane, violent or offensive.
• Once you have approved the design and the design is installed it is considered to be COMPLETE. Additional revisions are subject to the hourly fee of $45 per hour.
• Please be advised that installing items like music players, slideshows, mr linky, and any widgets other than blogger gadgets and wordpress widgets is NOT included in the design that you are hiring Foundation Studio for (unless otherwise indicated in the design package). Should you wish to have these items installed, please contact us.
• You must have your design detail form filled out before project conception. If you have not filled out the form, your project will not be started.

CANCELLATION

All cancellations prior to conception will be charged a fee of 50% of the deposit. If you cancel after conception of the designs you will lose your entire deposit.

HOURS OF OPERATION

Our normal business hours are Monday through Friday 9-5. If you require maintenance after the posted hours, such as on weekends or holidays, you will be charged our base rate of $45 per hour with an additional charge of $45 per hour for after-hours assistance.

CONFIDENTIALITY

All correspondence and documents provided will be treated as confidential between the client and Foundation Studio.
These terms and conditions supersede all previous representations, understandings or agreements. Terms are subject to change without notice.

Please be aware that upon purchasing any package you are agreeing to the Terms of Design as stated on this website.
